in Bedbug Questions

Question by scrooge:
how can I report a lawyer who misled me?

I am poor and living in a bedbug infested apartment.
a lawyer at a housing clinic encouraged me to abandon my apartment, leave everything behind, and buy new furniture bedding and clothing.
after going deeply in debt, this lawyer tells me I don’t have a case.
where can I report her?

Report her to whatever legal association represents lawyers in your area. The state bar association in the US, the Law Society in Canada, etc.

I would be very surprised if any lawyer advised you to abandon your apartment and goods and seek reimbursement. That would never be a valid claim.

The right thing to do would be to report the lawyer but unfortunatly i don’t think you have much of a case unless you have it in writing. If he/she didn’t charge you for his/her services then I don’t think they could be punished for that horrible advise they gave you. I’m sorry i can’t give you anything more hepful.

You were living in a poor condition in a bedbug infested apartment. You met a lawyer at the housing clinic who told you to abandon your apartment and leave everything behind. And buy new furniture and bedding plus clothing.

HOW COME YOU CAN BUY THINGS when you told us here you are poor isn’t it? So how can a poor guy buy even a new furniture please kindly explain this mystery to me.

THE LAWYER IS CORRECT when she told you that you ain’t got a case. Because you can buy things like bedding and other clothings yet you are presenting your case as A VERY POOR PERSON AND LIVING IN A VERY POOR APARTMENT. So two things doesn’t jive with one another here. And you want to report her? REPORT HER FOR WHAT? For misleading you?

THIS IS NOT MISLEADING. You yourself has brought this misery upon yourself. If you are poor as you told us here, why would you abandon your own apartment huh?! And live where? In a Mansion? YOU GOT NO CASE KID. You are just fooling yourself.

I understand it is possible, though expensive and unlikely, to be able to fumigate every item in household to destroy bedbugs. That is why she probably advised you to leave it behind. If bedbugs are infesting building, just fumigating one apartment will be futile.
The problem you would have in court , is proving that someone else brought the bedbugs into the building. Then you would have to identify, with legal certainty, who that person was. Then if the court found your evidence compelling and found in your favor, the person(s) found by the court to be responsible, would have a judgment against them. Then, if they had any money, you would have to take separate legal action to enforce the judgment.
Further, whomever you believe brought the infestation, might defend themselves by accusing you of bringing the infestation, and the court might believe them , and find against you, and you could end up being financially responsible for the infestation.
Whether roaches, bedbugs, rodents, proving the source is almost impossible.
Regardless, whether the attorney advised you to leave or not or buy new things and get a different apartment or not, those choices are still yours.
Did she explain why you don’t have a case, besides what I menationed? Perhaps you were not the legal tenant, or some other reason.
You can file a complaint against the attorney with the state bar association.
