Can I sue if I move into an apartment infested with bedbugs?

I’m getting bitten every night.
The apartment had bedbugs before I moved in according to the previous tenant. Also, the people who live downstairs have had them.

You’d probably have to prove the bugs didn’t come with the mattress you brought in…

Sue for what. Have you sought any medical treatment? Have you brought this infestation problem to the attention of your landlord? If not, you should. See if you can get the problem resolved without bringing litigation into it. Geez.

yes and with that money you should move into another apt. and to if he had that matress and didnt get bit in his old place and brought it here common sense (for those of us who have it only) tells us they were there already.

You would have to prove that they were already in the apartment before you moved in. Since they typically live in furniture (like a bed) it’s probably unlikely unless you moved into a furnished apartment or moved in with a roommate. In either case, if the bedbugs did not come from your furniture it would make more sense to use this as a cause to break your lease. If there is some kind of bedbug (or any bug) infestation in the building or in your roommate’s furniture you will have to wait for the other party to fix the problem.

Only if you can prove that the bed bugs were there when you moved in…

and not that they moved in WITH YOU.

Also … IF/ Once you are able to prove that the bedbugs came with the apartment …you can only sue for the expenses that it cost to rid them and anything you had to discard (such as the mattress)…or cost for washing your sheets…

Probably not worth it…

Contact the Landlord and have him call an expert to exterminate.

If the landlord does not take action… you may pay and deduct from future rent…but check with the landlord first and put it in writing…

also look up the law in your jurisdiction about “pay and deduct” rent because the amount and rules/ regulations differ in States.
