House Rental Lease – when does it officially start?

I signed in the lease for my new house from sept 1st by paying advance and I moved out of my old house aug 31st (both houses are in the same apartment building). They checked my old house after i moved out and found bedbugs. So, they rented my new house to new people without even notifying us. When I asked them about the lease signed between us, he said legally the lease comes into effect only after he gives me the key to the house? Is this true? and can they do this ? Is this legal?

I SUGGEST THAT U SPEAK 2 AN ATTORNEY ABOUT THIS MATTER. THE LAW IS DIFFERENT IN MANY STATES. BUT WHERE I LIVE THAT IS NOT TRUE. IF HE RECIEVED MONEY FROM U AS ANY TYPE OF PAYMENT OR DEPOSIT 4 UR PROMISE 2 MOVE IN THEN HE MUST RETURN IT

Read your state statutes on landlord/tenant laws. Usually, though, a lease is legally binding as soon as it is signed. Do you have a copy of the fully executed lease?

However, he does not have to give you the keys to the unit if you have not fully complied with the terms of the lease i.e. transferring the utilities into your name, paying all monies due, etc.

The lease is effective as soon as it is signed.

You two signed a lease (contract) where the landlord promised to have the home available for move-in Sept. 1. The landlord did not live up to the promise; landlord is in breach of contract.

Your recourse is to sue for breach of contract.
